Can my HOA stop me from building an ADU in Tampa?

Updated October 2026

It can, if your recorded covenants restrict second units or exterior changes. As of October 2026, city or county ADU approval does not cancel private deed restrictions in Florida. St. Petersburg states it directly: an HOA may restrict ADUs.

Why are zoning and covenants separate?

Zoning is a government rule about land use. A declaration of covenants is a private agreement recorded against your property. A permit says the government is satisfied; it says nothing about whether you comply with your neighbors' recorded agreement. Florida homeowners' associations operate under Chapter 720 of the Florida Statutes and their own governing documents.

What language should I look for?

  • "Single-family residence only" or limits on the number of dwellings per lot.
  • Rules on detached structures, sheds, guest houses or garage use.
  • Leasing or rental restrictions.
  • An architectural review process for exterior changes.
  • Setbacks or height limits stricter than the county's.

What if the declaration is silent or unclear?

Ask the association in writing and keep the reply. If the wording is ambiguous, a Florida real estate attorney can tell you how it is likely to be read. Building first and arguing later is the expensive way.

Can design help?

Sometimes. If the HOA allows the unit but controls appearance, we can match roof pitch, materials and colors, place the entrance away from the street and submit a full exterior package to the review committee alongside the permit set.

How do I know whether I even have an HOA?

Whether covenants apply depends on the subdivision plat and recorded documents, not on the city or the age of the house. A title search or your closing documents will show what is recorded against your lot.

When can an HOA not stop it?

It depends on what the documents actually say. If they are silent on second units and the association has no architectural review, the HOA may have no basis to object. Some old restrictions may also have lapsed. An attorney can confirm, and we design to whatever the answer is.
